1. Introduction

Use of this website and the services provided via IT ("www.netvision.com.ph") is conditional upon you accepting the following terms and conditions. Unless otherwise specified, your acceptance of this User Agreement shall be indicated by your use of and/or registration with www.netvision.com.ph provided by Netvision.

These terms and conditions and our Privacy Policy, (together the 'User Agreement') form our entire agreement with you in respect of non-chargeable use of www.netvision.com.ph and supersede any prior agreement or arrangement with you in respect of www.netvision.com.ph.

If a company name is inserted in your registration request, then the User Agreement shall be between us and that company and accordingly unless the context otherwise requires, references to "you" and "your" in this User Agreement shall also be to that company. The purchase of [goods/services] from us is subject to our Terms and Conditions of Purchase. If there are any updates to this User Agreement or to the Terms and Conditions of Purchase, we will bring this to your attention on the home page of www.netvision.com.ph.

2. Availability of www.netvision.com.ph

We will endeavour to ensure that www.netvision.com.ph is available 24 hours per day without any interruptions. However, we reserve the right to make www.netvision.com.ph unavailable at any time or to restrict access to parts or all of www.netvision.com.ph without notice. The website www.netvision.com.ph is a general information service. We do not guarantee the full accuracy and completeness of the information contained therein but we shall endeavour to make the same as accurate and complete as possible.

We therefore make no representations or warranties in relation to those sites or their content, nor do we guarantee that the links work. It is your responsibility to ensure that that you provide us an accurate and valid e-mail address and other contact details and inform us of any changes to them. 7. Intellectual Property

8. Our Liability

We shall not be liable to you or in breach of this User Agreement for any delay or failure to perform any obligation arising under this User Agreement if the delay or failure is due to a cause beyond our reasonable control including, without limitation, the blocking or restricting of information to and/or from our network.

Except as expressly provided in this User Agreement, we disclaim any further representations, warranties, conditions or other terms, express or implied, by statute, collaterally or otherwise, including but not limited to implied warranties, conditions or other terms of satisfactory quality, fitness for a particular purpose or reasonable care and skill.

Save as provided below, we disclaim all and will not be liable for damage arising from breach of contract, tort (including, without limitation, negligence) or otherwise arising in connection with this User Agreement or www.netvision.com.ph. More specifically, we shall not be liable for: (i) any consequential, indirect or special loss or damage; or (ii) any loss of goodwill or reputation; or (iii) any economic losses (including loss of revenues, profits, contracts, business or anticipated savings), in each case, even if we have been advised of the possibility of such loss or damage and howsoever incurred.

9. Small Print

Either of us may terminate this User Agreement at any time. You may not transfer any of your rights or delegate any of your obligations under this User Agreement without our prior written consent. If we fail to enforce any provision of this User Agreement, that failure will not preclude us from enforcing either that provision (or any similar provision) on a later occasion. Nothing in this User Agreement shall confer on any third party any benefit or the right to enforce any term of the User Agreement.

If you believe that your intellectual property or other rights are being infringed by the www.netvision.com.ph, or if you are dissatisfied with www.netvision.com.ph or any aspect of our service, please contact support@netvision.ph as soon as possible.

What Personal Information about users does Netvision Gather?

We collect and hold the following types of personal information:

Information relating to different types of individuals who represent our customers and target customers as provided to us by those individuals or obtained in the public domain from other sources such as magazines and newspapers

Does Netvision Share the Information It Receives?

Information about our customers is an important part of our business. Use of Third Party Service Providers:

We may, from time-to-time, employ other companies and individuals to perform functions on our behalf. Hence, information obtained about customers are shared with them but only to the extent necessary for the conduct of their service. Our site and disc products may include third-party advertising. Some of our advertisers use third-party companies to serve their advertisements that appear on our site. How does Netvision store the information it receives?

Netvision endeavours to take all reasonable steps to keep secure any information which we hold about you, and to keep this information accurate and up to date. In addition, our employees and the contractors who provide services related to our information systems are obliged to respect the confidentiality of any personal information held by Netvision.

Rights of Access to your information

You are entitled to know whether we hold information about you except to the extent that we are entitled to deny access under federal privacy law. Our business changes constantly hence our Privacy Notice may change as well. We may e-mail periodic reminders of our notices and conditions, unless you have instructed us not to, but you should check our Web site frequently to see recent changes. Unless stated otherwise, our current Privacy Notice applies to all personal information that we have about you and your account.

REFUND POLICY

Our website makes available video trailers of the different contents which we offer for sale. The users are encouraged to watch said trailers for purposes of choosing the specific video quality and content, which he desires to purchase. Hence, upon purchasing the chosen video content, it is understood that such sale transaction shall be final and non-refundable.

Errors caused by the user's system, i.e., Internet browser problems, connection faults, PC crashes, incompatible operating systems / softwares and the likes, are outside the boundary of the neTVision service and are not grounds for refund.
